AUS-CITY

Joysat and other companies

Aus-city is totally paid for by D cottle out of his own pocket and since this site has no sponsors we do not allow any advertising on it, It has nothing to do with UBI or tv plus, this rule lives with most forums around Australia.
And just think how many times I have bought sat stuff from your shop and you didn't even give me a discount and now you want to advertise your company on my turf.
Phil

that new forum No not the ja forum the lastest forum again they like using your name and tell you that you are not welcome there,at least they don't abuse you there yet, got me stuffed phil you do nothing and they talkabout you, He says he is from joysat buy as you know My brother buys stuff of them in Brisbane and there asians and most asians are not bothered with forums so it must be one of there employees and they do have a contractor that use to be on your forum like a member called Tracesat_Brisbane, loose lips sink ships funny how the word gets around 2000K away.

I don't worry about other forums. I just worry about Aus-city. We all know this is the best forum for UBI and PBS where you can get genuine help ( I have helped heaps and They aren't even on this forum). As for Joysat I don't worry about them either. I have been there a few times and bought a bit of stuff off them and if their prices are still right I will still go there and buy stuff off them. I had some very confidential information given to me only yesterday. I was going to pass this on to the concerned party but due to the above I will not bother. My saying is, he who lives by the sword dies by the sword.
Phil

Of course REMOVED ADD BY LAZER have nothing to do Joysat.Joysat is only Incel's supplier.I'm sure if you selling someone products you can use they name, same with Compaq we are Compaq Business partner for long time, that mean if you deal with Incel you are welcome to use my brand name, or my logo for you marketing thinks, but you are not welcome to use my name on your tax invoice etc.
For Dan04 I know you have phoned on my mobile yesterday, you say you are from Gold Coast and you want to watch Arabic TV from UBI, I'm not sure what is the point for you call, you just throw away money for ph calls., if I can help you I'm happy to do, to sell you but for installation I can not help you is just long way from us, will be cheaper for you if you find someone on Gold Coast, or if you are interesting I have friend there.
And last think did you saw web side REMOVED ADD BY LAZER in USA or REMOVED ADD BY LAZER and others world wide, which using my business name REMOVED ADD BY LAZER tell me what can I do??

[ 17. Of course I'm with that, but anyway Joysat headquarters is located in Australia, You right Phil, but other People don't understand, to much confusion, it is all about business hope others they understand.
Above User (joysat Australia Junior Member) I think is one of agent from above business which trying is well to advertise they business, and some detail from above company is incorrect, it is big different, between agent and reseller/distributor,(think) .And anyway if you are from Joysat Australia you should know how long Incel is trading with you.Don't be child, I have just talk with Henry, he is big boss from Joysat he said he has not write this message above, and you know what he just said to me?I'm very happy because, there is talk about Joysat the one of reason is I'm getting rating, more business, remember the word of mouth is best advertising today.

ps, I think new user Joysat Australia is one of agent from Qld, you can all see which one's I'm talking about from above named agents, because if is someone from other state will put Incel under, anyway we are independent company and we are not no one agents.Only once in past we did have contract with new HP Compaq for agent and that is all.

What Happens If I Register A Business Name Or A Pty Ltd Company?
What Rights Or Protection Do I Get?
The business name or the Pty Ltd company registration does not give you protection of your proprietary and intellectual property interest.

The Business Names legislation and the Australian Securities and Investment Commission is concerned with the establishment of a public register of business and Pty Ltd company names and their particulars. They are not concerned with conferring rights or protection in respect of such a name. You should, after deciding on a business name or a Pty Ltd company, conduct a thorough search of the Trade Marks register to make sure that the business name or the Pty Ltd Company name is not similar to any registered mark.

Business names and Pty Ltd company names are best protected from exploitation when they are registered trade marks. On the other hand, your new business name or Pty Ltd company name may infringe a registered trade mark. Be sure to search the trade mark database before registering a new business name or a Pty Ltd company name.

What Is A Trade Mark?
A trade mark can be a word, phrase, letter, number, sound, smell, shape, logo, picture, aspect of packaging or a combination of these. It is used to distinguish the goods and services of one trader from those of another.

A registered trade mark gives you the exclusive legal right to use, license or sell it within Australia for the goods and services for which it is registered.

Trade mark registration is not compulsory but it is advisable. There is protection against misrepresentation under the trade practices or fair trading legislation. It is also possible to take action under common law but this can be a time-consuming and expensive exercise.

Is there a difference between a trade mark and a business, Pty Ltd company or domain name?
Yes.

The difference between trade marks, business, Pty Ltd company and domain names sometimes causes confusion for both traders and the public.

A Pty Ltd company name or a registrable body must be registered under the national Corporations Law administered by the Australian Securities and Investments Commission. Once registered, it covers the whole of Australia. If a Pty Ltd company wishes to trade using a name other than the registered company name, it will be necessary for the company to register that name as a business name.

A business name is a name under which a business operates. Registration serves as a means of identifying the owners of the business and is obtained under state or territory legislation. Registration of a business name in any Australian state only gives you rights in respect of the particular state where the registration is made.

Where trading occurs in more than one state or territory, the business name must be registered under the laws of each one. Registration of a business name is compulsory and must be completed before the business starts trading.

A trade mark is used to distinguish the goods or services of one trader from those of other traders. Registration of a trade mark gives the registered owner exclusive use of the trade mark throughout Australia.

Registration Of A Business, Company Or Domain Name Does Not In Itself Give You Any Proprietary Rights-Only A Trade Mark Can Give You That Kind Of Protection.

The same word(s) may be registered by different people as business names and trade marks. However, the registered trade mark owner can sue the business owner for infringing the trade mark if the business name owner uses it on goods or services similar to those covered by the trade mark registration.

What About Domain Names?
In current times, besides deciding on the business name and the trade mark, a trader also has to consider the registration of a domain name to protect their intellectual property.

A domain name is a textual address for a location on the Internet that corresponds to the actual alpha numeric address which the Internet computers can read. The rules for registration of a dot.au domain used to be quite strict. Since 1st July 2002, the ability to register domain names under the dot.au category has been relaxed significantly. You should see http://www.melbourneit.com.au for the latest information on registration of domain names.

What can you do??

Why thanks to TV??
... You may not be able to stop another party from using your preferred domain
name even if it is identical to your trade mark if: ...

Similarly, no one has an automatic right to a domain name. Just because you have a company or business name, or a registered trademark, does not automatically give you a better right than anyone else in the corresponding domain name. The domain name system is entirely separate from the trade mark registration system.

An Internet Domain name, unlike a registered trade mark, does not give the owner any intellectual property rights.
Be aware that domain names allocation rules have changed so that you may now be eligible to obtain a domain name that matches your registered trade mark or registered trade mark application, even if it is not your registered business name (If this name has not already been allocated).

If the domain name is merely registered but is not used in the course of trade then an infringement of the trade mark is unlikely to be sustained. Conversely, evidence of a domain name being actively used would be relevant in demonstrating prior use of the mark within Australia, and could be a case against trade mark registration.

You may not be able to stop another party from using your preferred domain name even if it is identical to your trade mark if:

they are not attempting to 'pass off' trading on your name.
IPAustralia's trade mark database at www.ipaustralia.gov.au/trademarks;
the www.ausregistry.com.au for .com.au, org.au, asn.au, and id.au and gov.au names; and
the www.aunic.net site for edu.au names.
Incel go for it.

From someone who's brother is solicitor.
