To avoid being caught in those situations, we have to have to place high priority on the importance on good manners.

One mother had her child taken away after falling out of a window and becoming temporarily paralysed. Social workers portrayed it as a suicide bid, and her as an alcoholic and a drug addict.

Scarcely a week goes by without more evidence emerging to indicate that our �child protection� system is so dysfunctional that it should be looked on as a major national scandal. On one hand, we see the number of applications by social workers to take children into care soaring to nearly 1,000 a month, having more than doubled in the four years since the tragedy of Baby P. On the other, we hear of horrific episodes, like those recently reported from Rochdale and Rotherham, where social workers and police turned a blind eye to the systematic mass-rape of underage girls, many themselves in state care.

For three years I have been investigating scores of cases of children seized from their parents for what appear to be quite absurd reasons. This outrage has not yet come to the centre of national attention only because our child protection system hides its workings behind a veil of secrecy. I have been amazed to discover how our family courts routinely turn all the cherished principles of British justice upside down. The most bizarre allegations, based on hearsay, can be levelled against parents who are then denied the right to challenge them.

Although I have reported on several such cases more than once, they drag on through the courts so long that I haven�t been able to explain how they ended. I summarise three of them here to indicate why this is the most disturbing story I have covered in all my years as a journalist.

I am the father of the Child Luke Borusiewicz. I have some concerns regarding circumstances surrounding the death of my son resulting from injuries which occurred on Monday 12th of January, 2009.

He was not under satisfactory supervision at the time of his death.
I disagreed with decision to place my child with a 74 year old woman who was already burdened with three older children, all at home on school holidays. This would make it virtually impossible to show the care and attention needed for a two year old child. I voiced my concerns to Child Safety officer Liz who supervised my visits with Luke, immediately upon her informing me of his change of residence and carer. I also stated I was worried about the 3 older children bullying my child, and a constant list of previous injuries which he had sustained.


The injuries sustained by my child.
I am puzzled by the severe bruising of his right pointer finger. The police are confident the old lady was not capable of causing such an injury but I would like you to take into consideration it may have been caused by one of the other children, who were the only witnesses to the actions which caused Luke�s death.

My suspicion is that he may have been held by the right pointer finger by someone�s left hand whilst being struck by the other hand. Not knowing the size of the other children I would ask that you consider and investigate these as legitimate possibilities.


The constant injuries sustained by Luke whilst in the brief care of this elderly lady.
These included a severe burn to his hand and constant severe bruising to his head and body. At the day I last had contact with Luke he had scratches on his face which I asked the visit supervisor Liz to record. Other injuries were also witnessed by visit supervisors, Peggy and Joanne at previous visits.
Two days after my last visit with Luke his mum saw a severe scratch on his penis which needed medical attention. I was also informed by Joy during this week prior to the injury that he had severe bruising on his bum. She stated that it was from jumping off his bed. She informed me that she could not control him and he kept jumping off the bed. Did she inform child safety that she was not capable of proper care and control of Luke.
Why haven�t Child Safety been forthcoming with the list of previous injuries?


The failure to act on my concerns as a father about my child�s safety with this carer.
During the week preceding his fatal injury and immediately upon being informed of his placement with this carer, I embarked upon a tireless but futile attempt to have him removed from Joys custody.

The contacts I made with child safety include:-

When I spoke to the visit supervisor Liz during the visit on 5.1.09
A phone call with Liz 6.1.09
A phone call with Josephine from child safety complaints in Brisbane on 9.1.09
A meeting with supervisor Liz and Team Leader Joe on 9.1.09
3 unreturned phone calls to Pat Anderson manager of Child Safety in Cairns. 2 of these were on 9.1.09 and one was on 12.1.09.
Luke�s mother, Jacky, also voiced her concerns about his safety whilst in the care of Joy.



Why he was not given proper care at the time of his injury.
Why was he allowed to �sleep� from 11am til 5pm. I rang the carer, Joy, at 11am on the day of Luke�s injury. She informed me he had returned home, hit his head whilst having a tantrum and had been put to bed.
I was very concerned after this phone call and immediately attempted to contact Pat Anderson, the manager of Child safety in Cairns. This was my third attempt to contact her and voice my concern over his safety whilst in the care of Joy. None of my calls were ever returned.
I also rang Liz from Child Safety Cairns and repeated my concerns. This was the third time within a week of the fatal injuries occurring, that I informed Liz of my fears for Luke�s safety. First, at Luke�s visit the week before, and secondly, during a phone call when she informed me, two of the children were to be removed immediately so that Luke would receive proper care. The third time was during a phone call to organise a meeting with Liz and the Team Leader Jo.

I phoned Joy�s home phone at 1.30pm on the same day. The phone was answered by a child, who informed me Luke was asleep.
I rang a third time that day at 5pm to talk to Luke and was told he was still asleep. I commented that he doesn�t usually sleep that long and told her I would ring again soon. I did not want to upset his carer so decided to ring again the following morning.
My mobile phone activity report can verify the times, when I rang.


The inaccurate account of times supplied by his carer
I am suspicious of the reasons for supplying a misleading account of times for Luke�s injuries occurring and when he was put to bed. His carer knew his usual time for a daytime sleep was 1.30 and that it was highly unusual for Luke to go to sleep at 11am. As he returned from the visit an hour and a half earlier than normal, Joy would have been informed and well aware of his early arrival. I am suspicious that she is trying to hide the fact that his going to bed at this time, had never occurred before and was therefore a result of his head injury.


I am also concerned, as the father of a deceased child, and as the father whose child was placed in a supposed - �sanctioned safe environment�. Who is responsible for sanctioning a 74 year old woman as a full-time carer of four young children. Even a responsible person half that age would have their work cut out for them, so why was Luke placed with a carer, who even admitted she did not want the added burden of another child; said, she did not want him � and yet, Child Safety saw fit to overload a 74 year old woman with a very active 2 year old, thus creating an extremely DANGEROUS environment of uncontrollability and neglect.
I believe the Child Safety Officers involved in the decision making processes of this case should be investigated thoroughly for neglecting their duty of care, - in (a) allowing a 74 year old woman to �care� for 3 children, let alone 4 � plus, what about the other three children still in her �care�? Are they �safe�?? Do they suffer constant injuries?? Is anyone monitoring this?? Do �carers� attend a basic first aid course, which would point out the obvious steps to adhere to if a child sustains a head injury- don�t let them sleep for 6 hours. Was it only my child who suffered constant injuries and would this be an indication of bullying from the older children.
I simply ask that you consider my concerns when you conduct your investigation into the matter,

The last time I played with my son Luke, he had only just turned two, and was a healthy little baby, apart from the scratches on his face. I was only allowed 2 hours a week with him for the last six months of his short life which ended on the 18th of January, 2009. Luke died at the age of two years and four months.

Two days after this photo was taken his mother had her 2 hour visit. Only after her discovery of more severe fresh scratches, thiis time on his penis, and after Lukes's mum insisted, was he taken to a doctor for medical attention. These injuries and others, including severe burns, multiple scratches and bruising were a constant in Luke's life, while he lived with his Queensland Department of Child Safety sanctioned foster carer.
Luke was left with a fractured skull, bleeding on the brain, and a blood clot, unconscious for six hours. Only after I rang the foster home a third time that day to check on his wellbeing, was he properly looked at and an ambulance was rung. By the time he got to hospital his brain had been so starved of oxygen that half of my little Lukey Pukey's brain was dead.
The first time I rang the house I was informed Luke had suffered a head injury and gone to sleep. I asked her to be very careful with his head as he had received a knock on the head before. She was awful to me, a 74 year old who already had 3 foster children in her care, two boys aged 4 and 6, and a girl aged 9.
Luke had been brought back to the same household where he had been inflicted with constant injuries before, after he was kicked out of his previous foster home, the day before Christmas.
I was not informed of Luke being placed with this woman until my visit with him on the 5th o January, and immediately questioned how this elderly woman would be able to look after him properly.
I informed the child safety officer he was always injured whilst in her care and that I was worried he would be bullied by the older children. I begged, he was fine with me, a previous visit supervisor had also begged them to let me have my son back. They told her I was paranoid but she strongly disagreed, but they had decided I was not good enough to be a father long before this.
Everyone could see how much I loved my son, and he would not leave my side. He was terrified of being removed from me, as they had done before.
I had moved to Townsville, which was the last step for me in my battle against drugs. I aquired secure work and earnec over a thousand dollars a week. Half of this money went to the best solicitor I could find. Child safety Cairns rrefused to sign over the paperwork, Luke was taken away from his mother and I in Townsville, as child safety refused to let Luke stay while I was partnered with his mother. We argued too much.
God works in mysterious ways, and my new employer was a drug and alcoholl counselor of twenty five years, and three of his success stories were my work mates. Two of those were his sons.
I put my mind into my work, and every morning when my phone alarm would go off at 5 am, Luke's photo would come up and I woul;d smile and say, "For you Luke, anything."
Luke was my reason for getting up every morning, my light at the end ot the tunnel was to get Luke back. I stayed drug free for six months until I followed Luke back to Cairns. Child safety Townsville put Lukey in two diffewrent foster homes then in a third house in Cairns. His mother was told she would have Luke if she left me in Townsville We were never given a chance to mend out relationship, offered any help or counseling or referred to anyone for help. They had decided from the onset I was to go, and the child woulld go with his mother. I prayed for my son for twenty years. He is the miracle God gave to me.
I moved back to Cairns, so I could keep up my two hour visits, which was all I now lived for. I went to child safety Townsville every day to show them I was working and drug free, and to beg for my son back. I got the same look I received from child safety Cairns supervisors, the elite who answer to no one, a look of hatred. I continued with ATODS appointments, I received counseling and advice from centacare, took voluntary urine testsand kept a full time job.
I couldnt work in Cairns, as I was doing too many courses and counseling, Lifeline, Centacare, Relationships Australia, ATODS, Solicitors, it was a full time job trying to get my son back.

I think the government needs to have more of a prevention aim rather than that snatch and grab method at present.

Prevention is better than cure.
