And I've highlighted only a few "interesting" parts of the contract

Anyway, I wouldn't let them into my house to do anything if they carry no responsibility for their work.
And if you are a tenant, there is no way in a world that your landlord would give you a permission to install Tv+ if he read that contract

I think these are standard, industry terms and conditions. I've checked out the terms for both Optus TV and Optusnet cable, and they have exactly the same type of clauses -

"Optus will take reasonable care not to cause any damage, Optus' installation, inspection and maintenance of the Service may cause damage to your premises. You accept the risk of any damage occurring, even if it is caused by a negligent act or omission of Optus or its employees, contractors or agents"

I've also had a look at UBI and they have many of the standard clauses that you'll find in these types of contracts -

"2.3 We may from time to time vary the programming of the Service or discontinue part of the Service without notice to you and without any adjustment to the Subscription Fee."

"2.6 Under no circumstances shall we be required or obliged to make good the Premises after an installer has repaired, removed or replaced the decoder box or satellite equipment."

"3.1 To the extent permitted by law, in no event shall we be liable for any claim by you for loss or damages including, but not limited to, claims for faulty design, damage done on connection of the decoder box, defects in the decoder box negligent or misleading advice, damages arising from loss or use of the decoder box, and any indirect special or consequential loss, damage, injury or death to any person or the property of any person and we, to the same extent limits our liability, if any, to you to the value of the decoder box and to the fullest extent permitted by law you hereby release and indemnify us and forever hold us harmless against any such claim."

[ 09. found it

" While Optus will take reasonable care not to cause any damage, Optus' installation, inspection and maintenance of the Service may cause damage to your premises. You accept the risk of any damage occurring, even if it is caused by a negligent act or omission of Optus or its employees, contractors or agents and agree this Agreement supercedes the General Terms "

http://www.optus.com.au/dafiles/WOCA/Shared/File/optus_television_terms-630.doc

Anothing thing that I came across, while scanning through UBI's terms was -

"2.3 If you wish to sell the decoder box, you must first offer to sell it back to us for our current buy back price. If we do not wish to buy back the decoder box it may only be sold or transferred to a third party by complying with the current procedure as advised by us at the time you wish to sell the decoder box."

To my recollection, I thought UBI wasn't supplying decoders and was referring people to 3rd party suppliers. Does this mean that even though you own the decoder, UBI has final say if you can sell it or not?

For me someone should ring the Office of fair trading and find the legalities of all this. The Contractor has to have public liability insurance period and if the contractor damages your house he will have to pay the damages, Period. I don't give a fuck what company it is the Contractor has to have insurance and its the responsibility of the pay TV company to see that he has.
Please someone ring the dept of fair trading or in Qld its office of fair trading.
