Greece has applied for restraining order against UBI world TV[/


An application for a restraining order was heard before a presiding Judge in Greece on the 27 June 2007 in relation to UBI World TV (Mike and Regina Boulos - ex-TARBS) breaching Australian copyright law by illegally broadcasting ERT.



The Court issued the restraining order and told the defendants to cease infringing distribution rights in Australia, America, Asia, African Continent and Oceania via satellite, cable, digital cable, IPTV, and internet television or any other suitable medium for radio and TV transmission and to desist from any further infringement in the future.



This means UBI must desist from broadcasting ERT immediately which will affect many Greek Australians who have signed up to their service in good faith. Is this TARBS all over again?

This is the first I've actually heard of this Greece vs UBI.

ERT is actually broadcasted FTA on Optus B3 through 2 platforms: Gloebcast (Greek Government sponsored) and UBI (UBI Sponsored).

Even 'if' UBI did loose ERT, UBI subscribers can still watch ERT through the public mode on the UBI STB.

ERT should be ashamed of doing such a thing (if they did) as UBI is just extending ERT's reach at no cost to the Greek Government.

Greek Minister of Diaspora has officially declared during his visit to Australia about a year ago "any platform who wants to broadcast ERT as FTA, is welcome to do so" and he is on record saying this.

Big deal if UBI lose ERT UBI has been broadcasting it FTA all this time

I don't subscribe to watch ERT and never will only decent thing they got is sport which next season a few teams have gone to other channels such as ALPHA

If this is the beginging of ERT becoming a Pay TV channel after all these years good luck to them as there wont be many I know that will even pay for this channel

Could it be that SelecTV is pushing ERT to become a pay channel to somehow compete with UBI as now the only channel they have is Ant1 and ERT is Free for all to watch so might be SelecTV pushing ERT to become a pure Pay TV channel just a thought and proberly rite smile

Is there a source to this information you have like a website or something?

BTW UBI only broadcast ERT FTA in Australia they dont broadcast it to America, Asia and the rest of the regions listed in your info....

For me ERT is just an added bonus and it wasen't there I couldt care less and would rather watch paint dry then watch ERT sometimes well most of the time LOL

Prediction ERT becomes Pay TV by end of Year and only available thru SelecTV .....

Doesn't matter ERTS content is not UBI's to do whatever they wish with.

If you havent noticed the forum has been quiet long before this so visit more often to see alot more of nothing and quietness....

The rumour around is that select tv might want the channel out right. but as most of the Greeks said to me that have ubi they don't give a rats arse about ERT because in their words its at the end of the customers pecking order.

UBI ordered to stop broadcasting ERT

A SYDNEY-based multicultural pay TV service has been served with a court order from Greece demanding they stop broadcasting one of the country's major channels to Australia.

UBI World TV received legal documents late last month, claiming they were breaching Australian copyright and distribution laws by illegally broadcasting the ERT channel.

A civil application by Comart, a Greek telecom company that looks after ERT's broadcasting rights in Australia, was heard before a presiding judge in Greece on June 27.

Comart accused UBI of broadcasting ERT without any official agreement with the channel, and threatened its chairman Mike Boulos with jail time if he refused to pull the plug.

Mr Boulos told Neos Kosmos English Edition last week he did not understand why UBI was being targeted, arguing he was allowed to broadcast ERT because it was a free-to-air channel in Australia.

He claimed UBI has never charged customers or the channel itself to broadcast ERT.

"I believe we have done everything correctly in terms of broadcasting ERT in Australia as a free-to-air signal," he said. "It's in accordance with a set of guidelines... saying anyone that was capable of re-broadcasting the ERT signals, as long as they didn't charge for it... were allowed to do it."

He went on to highlight Greek Foreign Undersecretary Theodoros Kassimis' visit to Australia last year, where he promised to continue allowing free access to the ERT satellite channel.

Mr Boulos said he was baffled as to why ERT did not launch the order itself, or why they never responded to any of his written statements.

A spokesman from the Greek Embassy in Canberra told NKEE they have received minimal information about the order, other than confirmation that ERT did not issue it.

Mr Boulos said UBI would fight the order, and would not pull the plug on ERT.

"Absolutely not, unless I receive responses to my letters, and the Greek citizens of Australia say 'take it off'," he said. "It's just farcical. I provide it as a service to the Greek community.

"With no disrespect to the Greek court, UBI is an Australian company. It does nothing in Greece, it doesn't even get its ERT channel from Greece. It receives the ERT channel from a signal that is available free-to-air over Australia, and it retransmits it to anyone who wants to see it that's within the footprint.

"If Comart would like to contest this, I look forward and welcome them to Australia where this matter can be dealt with accordingly."

Comart refused to comment on the record about the order, referring all questions to ERT President Christos Panagopoulos.

Pay TV provider SelecTV, who also provides Greek channels to Australia, including ERT, told NKEE they were "keen" to see UBI cease transmitting the channel.

"It just makes a mockery of paying rights for foreign TV channels," SelecTV's CEO Jim Blomfield said. "They're taking an unfair advantage by transmitting it without permission from the rights holders.

"We have a very straightforward relationship with the Greek audiences and it's disappointing when you're trying to run a straightforward business and do everything as per broadcast regulation and the courts."

Mr Blomfield said SelecTV broadcasted ERT legally from a US signal in cooperation with Comart, while UBI abused the use of the B3 satellite, where the channel can be accessed free-of-charge.

"We're paying licence fees, which you're meant to if you're going to transmit or retransmit that channel," he said. "We find it offensive that somebody else is transmitting it without paying any fees. Cleary there's a disadvantage to us when others feel they don't need to pay."

Mr Blomfield said SelecTV may also take legal action against UBI depending on the conclusion of Comart's case.

"Once we see the outcome of the current proceedings... we will then consider what action we will take," he said.

Mr Boulos said UBI appointed a lawyer to appear at the necessary court hearings in Greece.

UBI is a pay-tv business providing the Greek community with 10 TV and 12 radio channels. 80% of the UBI Greek subscribers are over the age of 60.

ERT is a Government channel and currently rating 7th in the Greek TV market, however is a highly respectable channel.

Certain ERT management is in conflict with the direction of the Government and the people appointed by the Greek people.

Ο υφυπουργός για την ΕΡΤ, ανέφερε ότι όντως θα συνεχίσουν να την βλέπουν δωρεάν οι ομογενείς. Διευκρίνισε δε, ότι και όποιος καλωδιακός φορέας θα θελήσει να δείχνει χωρίς συνδρομή την ελληνική δημόσια τηλεόραση θα μπορεί να το πράττει. (EΡΤ)

And roughly translated into English

UBI is simply providing the ERT signal as FTA to the greater community allowing a greater number of people to view ERT.

Upon the publishing of the guidelines (as above) and prior UBI has written to ERT directly advising them that UBI have followed those guidelines and adopted them nearly a year ago.

It’s difficult to comprehend how an alleged copyright infringement that has taken place in Australia be dealt with in Greece with less than 12 hours notice.

UBI will continue to rebroadcast ERT for the benefit of all Greeks including those who have subscribed to UBI until ERT itself or the Greek Department of Foreign Affairs makes it intentions clear.

SelecTV doesn’t pay any money for ERT is not in a position to charge for it.

A failed CEO such as Mr Blomfield shouldn’t be making such comments as he did in NEOS KOSMOS newspaper regarding court cases. UBI looks forwards to Mr Jim Blomfield to take action now against UBI if he thinks he has the necessary facts.

UBI is hopeful for the Greeks that SelecTV continue to service this dedicated ethnic market.

ERT management for more than 2 years have constantly put out tenders for the distribution of the signal worldwide have continually postponed the tender and the parameters of the tender so they are in favour of COMART and no one else. One must wonder what is the point of running a tender if the outcome will always be in favour of Markos of COMART?

UBI will continue to rebroadcast ERT at the expense of UBI for the benefit of the Greek subscribers and of course the benefit of the wider Greek community.
