Hi All,

As some of you may know there is some debate who has the rights to broadcast BHT1 to Australia, TVPlus or UBI World TV, and why the signal on BHT1 freezes during certain programs. I have been in contact a few days ago with the BHT1 Satellite Director and this is what he had to say.

TV Plus je prva kompanija sa kojom smo sklopili ugovor o distribuciji naseg signala u Australiji u najboljoj namjeri da i nasim gradanima u Australiji omogucimo pracenje naseg programa. Posto nisu postivali ugovor i otezali sa pocetkom distribucije signala, s njima smo raskinuli ugovor, a oni su neovlasteno poceli sa emitiranjem, koriste piratsku karticu i takode neovlasteno emitiraju cjelovit program, zbog cega smo trenutno na sudu. U meduvremenu smo sklopili ugovor sa kompanijom UBI koja preuzima nas signal ali samo nekodirani dio programa, jer bi u suprotnom ucinila zakonski prekrsaj po pitanju tv-prava, za sto bi konsekvence snosili i mi i oni. Kad smo se dogovarali sa UBI-jem govorili smo o ubacivanju domaceg programa umjesto kodiranog, ali za sada nemamo tehnickih mogucnosti za to, a kada se tome doda izuzetno teska financijska situacija u kuci tesko da cemo moci rijesiti taj problem. U planu je bilo pripremanje namjenskog sat-programa za Australiju i USA, ali iz istih razloga (financijskih) u pitanju je i produzenje o najmu satelita. To je nasa stvarnost i ostaje nam da se nadamo da cemo prevazici ove teskoce.
Sto se tice UBI-a, od njih ne dobivamo jos nikakvu naknadu dok se ne okonca sudski proces koji traje vec mjesecima, pa probleme oko vaseg placanja pretplate UBI-u trebate razrijesiti sa njima. Zahvaljujemo se na javljanju i zeljom da Vas sto prije obradujemo sa boljim vijestima.

Summing up what he said..(quick translation)

TV Plus was the first company which we negotiated the signal to be broadcasted to Australia and we thought that this would be the best so our Bosnian Citizens would be able to watch our channel. But because they did not follow the contract properly and took forever to start the signal we broke up that contract deal, and then they began transmitting our signal illegally, and they are using a pirated card. We are now in the courts to resolve this issue. However currently, we have made a deal with UBI but only the non-coded side of the program to be transmitted; because of copyright violations we cannot transmit the full signal. When we were in negotiations with UBI we talked about local produced programs instead of coded, but currently we do not have the technical equipment to be able to do this. Currently we do not have money and it is a financial problem to be able to do this, this is our standing at the moment but i am sure in the future we will overcome this.In the pipeline is to make a SAT program for Australia and USA with enough financial support and local produce.
We have to wait until the court case is over to resolve the signal issue and BHT Sat version from there on.

load of crap i say..this just tells you how the national broadcaster responds I cant believe that "they don't have enough material to create sat version"..They have such a big archive plus so much to show...hey if BN can do it I am sure BHT1 can too! Plus they are getting loads of money from the humanitarian organisations...I think there is more to the story here too...

Also UBI chargers the customers for the program here while BHT gets 0! Hmm not sure how they are better off anyway...No wonder RTS has no desire to join...and look they even have the sat version...I think BHT is just plain lazy to make sat version. Hey if NTV hayat, Bn have sat versions then I dunno.
But anyway we are eager all to hear these news from UBI in regards to the BALKAN BOOM channels...guyz i am all ears

As far as the court case goes BHT will have to provide some strong evidence how Tv plus has broken the contract (I assume not paying BHT a cent ONLY IF THAT TERM WAS IN THE CONTRACT) as far as the distribution time of the signal I think BHT couldn't care less when indeed it ll be or should I say was meant to be distributed, just consider the sentence "we dont have enough material to create sat verrsion"...they don't care less for the satellite version....well sorry when UBI starts opening the bag then maybe..thats my 5 cent to this story

I didt see anywere that they said they dont have enough material to me it says they dont have money to create another channel as to have another channel a seperate team of people is needed of a few people plus more infrastructure to create, edit and beam that signal this is where the money problems stand from were im sitting

At the end of the day BHT are the rights holders to BHT if they see fit that TV Plus were not fulfilling the contract so be it TV Plus didt broadcast BHT for over a year until UBI started broadcasting it when the contract was VOID And INVALID and then TV Plus decided lets go buy a pirate card ( since BHT dont authorise us to broadcast BHT anymore and the contract is invalid and VOID ) and pirate the signal to Australia and not pay BHT one red cent ever since the start

You say that BN and NTV have sat channels so why not BHT maybe cause BHT funding is alot less since NTV And BN are commercial networks they would have alot more money to play with in my opinion

Anyway TV Plus keep pirating that signal with the 8-16 hour delay on it everyone can see now that you are in the wroung specially with one of the BHT directors saying you are pirating the signal so keep up with it the longer you do it the worse it is for your case wink

thats what i am saying lazersat u cant just say "I ll void the contract and say its invalid if u feel like it"..there needs to be a great amount of proof if the terms of the contract weren't fulfilled and have been violated...the contract cant be void just like that as u say no matter WHAT RIGHTS THEY HOLD the fact they entered the contractual relationship with TV PLUS indicates that they are obliged as a signatory of the document..now it depends on a few things. The contract can not be invalid as both parties have agreed on the terms so the contract is valid however may be voidable if the therms of the contract have been violated.
I now see why this case has been ongoing for sum time..
For courts to determine if something has become part of the contract and if it was breached the courts do 4 things:

a) they ascertain whether parties actually signed and agreed
b) they determine whether they intended those statements to BE CONTRACTUALLY BINDING
c) they determine the level of importance the parties intended to attach to those statements
d) they provide an appropriate and adequate remedy in the even of any breach

1) what terms of the contract tv plus has breached so that BHT can say we are pulling out and if those were binding to the contract

2) depending on the time too, if the contract has expired with TV PLUS and hasnt been renewed with either parties then tv plus has no rights to have the CH

as far as liski say its been paying BHT well this is not wat their rep says i am only quoting what he says

As far as the UBI goes, we have not received any money, until the court decisions has been reached"

As I say they are only pirating the ch I guess if there is no contract between them for which I don't know how long it has been since they initially signed but I am guessing it has expired since I ve heard that they are renewed on a yearly basis...

I'll say my last piece on this as posts are becoming to long to read lol

If TV Plus win there still losing cause the contract with BHT has either expired or about to expire that was originally signed with BHT so BHT will not renew it as the courts show that BHT and UBI are both applicants together going up against TV Plus so its a lose - lose situation for TV Plus so all this fighting in court is it really worth it TV Plus and not paying BHT since the day TV Plus signed BHT doesnt make things any better and using a pirate card to access the signal just puts the topping on top of the cake LOL smile

I know UBI is paying for the transmission costs, there is no doubt about it, I was referring that BHT get nothing the same with TV PLUS..

TV Plus is not using an authorised feed though they are broadcasting stuff there not suppose to our region so they are violiting copyright laws plus using a non authorised feed from BHT

From what I've been told UBI does pay some sort of fee to BHT - I don't know the actual specifics as it's not my department.

LOL it dunt matter how many applicants there are... TV PLUS yes eventually they will loose, as BHT wont renew the contract even if they win so again they ll loose..now the only thing they need to work out r the remedies ;P

Not sure that's part of the contract between TV PLUS and BHT...its not BHTs problem while the contract was in force.

hey it looks like UBIs feed of BHT1 now has become 24/7. Havent seen any freezing for the last 3-4 days I think thats some promising news laugh

Even managed to catch the soccer action this morning Bosnia vs Iran laugh

guys,I have got ubi world tv decoder box and I was wondering if I can use it to watch Turkplus? everytime I try to go to instilation ask me pin code? so I bought that box year ago any help will be appriciated thanks in advance.my UBI DECODER BOX IS UEC STB
