Interesting Letter from Panamsat Lawyers on www.apsattv.com about Horizons TV

From Dean Rutherford

Dear X

We act for Globecast Australia Pty Ltd (“Globecast”) and PanAmSat Asia Pty Ltd (“PanAmSat”).

We would like to inform you GlobeCast and PanAmSat have suspended the services of Horizon World TV due to non-payment of invoices by Horizon World TV. The satellite equipment on the relevant subscribers buildings is the property of PanAmSat. Horizon World TV was provided a license by PanAmSat to use this satellite equipment installed for the various subscribers. However, Horizon World TV’s licence was revoked by PanAmSat on 25 May 2006 due to their continued failure to pay their outstanding invoices to Globecast. Accordingly, neither Horizon World TV nor any other third party (including subscribers and installers) are permitted to deal with the satellite equipment in any way without authorisation from PanAmSat.

Our client instructs us you may be called upon by Horizon World TV to re-point the subscribers satellite dishes to another satellite. The purpose of this correspondence is to put you on notice our clients will immediately take legal action against you and Horizon World TV, or any other installer or person who deals with the satellite equipment without the necessary licence from PanAmSat.

Regards,
Dean Rutherford

SHANAHAN TUDHOPE LAWYERS
Level 7 60 Carrington Street, Sydney NSW 2000
Telephone: 02 92622888
Facsimile: 02 92994488
